represented by the site "KOGEIYA.com " or its staff.
The "customer" or "you": The individual or company having placed an order via the site with signature of the conditions of sale, or having marked its agreement following a manual order form.
The conditions of sale below are applicable between the store and the customer at the time of each order and take precedence over any other text from the moment the customer becomes aware of them. This knowledge is deemed to have been acquired with each order if the customer is automatically notified of them before the order is placed.
They can be modified at any time, and are valid for all orders placed after the modification.
2- Prices
The prices displayed on the site include all taxes (20% French VAT). However, these prices do not include delivery charges, which are payable by the customer, as these charges cannot be fixed in advance. Shipping costs are calculated according to the country of destination, the address and the total weight of the parcel, based on the rates charged by the carrier designated by the seller. For an estimate of shipping costs in advance (e.g. for the shipment of several items), it is possible to contact the seller by writing to the address mentioned in the first article.
Prices are subject to change at any time without notice.
Prices are definitively fixed upon finalization of the order and cannot be modified.
3- Payments
Transaction fees for card payments are non-refundable.
4- Delivery and transport
Shipping times are not contractual and depend on the carrier. They vary according to destination country and postal address. In France, standard postal delivery takes between one and three days. In Europe, delivery times vary between two and seven days. For other countries of destination, it is possible to ask the seller for an estimate by writing to him by e-mail at the address mentioned in the first article.
If the buyer asks to be delivered on a precise date or on this date at the latest, we undertake to do our utmost to respect this deadline. However, in the event of a recorded delay, the buyer may refuse his order, which will be reimbursed in full, including postage.
The above estimates are purely indicative and apply subject to circumstances specific to the carrier and beyond the control of the seller.
In accordance with current French legislation, the risks associated with delivery (loss or damage) remain the exclusive responsibility of the seller until the transfer of risks, i.e. the moment when the customer takes possession of the goods delivered.
In the event of a damaged or suspect parcel, it is absolutely necessary to note any reservations concerning the condition of the parcel on the delivery slip.
It is strongly advised to notify the seller within 24 hours of delivery by e-mail to the address mentioned in article 1.
The above provisions do not apply when the customer, or a third party designated by the customer, uses a carrier of his choice, not proposed by the seller. In this case, the transfer of risks takes place when the carrier takes possession of the goods.
5- Withdrawals
In accordance with the provisions relating to distance contracts concluded in France, private (non-professional) customers have a period of 14 days from receipt to return their item(s) to the store for reimbursement or exchange. To exercise this right of withdrawal within 14 days of receipt, you must notify the seller of your intention to withdraw in a clear and unequivocal manner at the address given in Article 1. It is also possible to notify your intention to withdraw within the 14-day period by means of a standardized withdrawal form available on the Public Service website, to be sent, signed and completed to the address mentioned in the first article(https://www.service-public.fr/professionnels-entreprises/vosdroits/R38397).
This law does not serve as a guarantee in the case of defective parts, but in the case of an order error, for example.
However, the items must not have been damaged.
The costs and risks involved in returning the parts are borne exclusively by the customer.
6- Reservation of ownership
The transfer of ownership takes place when the customer has paid for the order in full. Until full payment has been received, the goods remain the property of the store.
7- Disputes
In the event of a dispute, only the Créteil Commercial Court in France will have jurisdiction.
In the event of loss by the customer, all costs will be claimed from him.
